Bullying in the Schools Essay

Bullying and intimidation are a major social problem in many cultures. Since it is widely considered immature and mean to perpetrate violent or threatening acts, it is not surprising that incidents of bullying are usually found among young people where they gather to socialize. Schools are a hotbed of bullying activity, and many children are victimized. Bullying has two key components: repeated harmful acts and an imbalance of power. It involves repeated physical, verbal, or psychological attacks or intimidation directed against a victim who cannot properly defend him or herself because of size or strength, or because the victim is outnumbered or less psychologically resilient. Bullying includes assault, tripping, intimidation, rumor-spreading and isolation, demands for money, destruction of property, theft of valued possessions, destruction of another’s work, and name-calling. There are different categories of school bullying, and some of the categories overlap. Here are some of the most important categories that are frequently discussed: 1) How Many Bullies †¢ Pack bullying is bullying undertaken by a group. Pack bullying was more prominent in high schools and characteristically lasted longer that bullying undertaken by individuals. Pack bullying may be physical bullying or emotional bullying and be perpetrated in person or in cyberspace. †¢ Individual bullying is one-on-one bullying that may take place either in person or online, as well as being physical bullying or emotional bullying. 2) Mode of School Bullying †¢ Physical bullying is bullying that takes the form of physical abuse, such as pushing, shoving, hitting, fighting, spitting, and tripping. †¢ Emotional bullying is bullying that involves factors other than physical interaction, such as insults, derogatory remarks, name calling, and teasing. 3) Medium of School Bullying †¢ Face-to-face bullying is bullying in which students confront each other in person. †¢ Cyber bullying is bullying that takes place online, through either email, chat rooms, social networking services, text messages, instant messages, website postings, blogs, or a combination of means. 4) Specific Targets of School Bullying †¢ Homophobic bullying is sometimes distinguished because it has a particular target population. †¢ Bullying of students with disabilities is another type of bullying with a focused target population. †¢ Racist bullying is a third type of focused bullying that targets people of a specific race or cultural. †¢ Religious bullying targets people who have specific religious beliefs. International research suggests that bullying is common at schools and occurs beyond elementary school; bullying occurs at all grade levels, although most frequently during elementary school. It occurs slightly less often in middle schools, and less so, but still frequently, in high schools. High school freshmen are particularly vulnerable. Most students do not report bullying to adults. Surveys from a variety of countries confirm that many victims and witnesses fail to tell teachers or even parents. As a result, teachers may underestimate the extent of bullying in their school and may be able to identify only a portion of the actual bullies. Studies also suggest that children do not believe that most teachers intervene when told about bullying. The same is true of student-witnesses. Although most students agree that bullying is wrong, witnesses rarely tell teachers and only infrequently intervene on behalf of the victim. Some students worry that intervening will raise a bully’s wrath and make him or her the next target. Many of the European and Scandinavian studies concur that bullies tend to be aggressive, dominant, and slightly below average in intelligence and reading ability and most evidence suggests that bullies are at least of average popularity. The belief that bullies â€Å"are insecure, deep down† is probably incorrect. Bullies do not appear to have much empathy for their victims. In Australia, research shows that bullies have low empathy levels, are generally uncooperative, and, based on self-reports, come from dysfunctional families low on love. Their parents tend to frequently criticize them and strictly control them. Dutch researchers have found a correlation between harsh physical punishments such as beatings, strict disciplinarian parents and bullying. A number of researchers believe that bullying occurs due to a combination of social interactions with parents, peers, and teachers. The history of the parent-child relationship may contribute to cultivating a bully, and low levels of peer and teacher intervention combine to create opportunities for chronic bullies to thrive. Most bullies victimize students in the same class or year, although 30 percent of victims report that the bully was older, and approximatel y ten percent report that the bully was younger. It is unknown the extent to which physical, mental or speech difficulties, eyeglasses, skin color, language, height, weight, hygiene, posture, and dress play a role in victim selection. One major study found the only external characteristics†¦to be associated with victimization were that victims tended to be smaller and weaker than their peers. One study found that nonassertive youth who were socially incompetent had an increased likelihood of victimization. Having friends, especially ones who will help protect against bullying, appears to reduce the chances of victimization. Victims of bullying suffer consequences beyond embarrassment. Some victims experience psychological and/or physical distress, are frequently absent and cannot concentrate on schoolwork. Research generally shows that victims have low self-esteem, and their victimization can lead to depression that can last for years after the victimization. Boys and girls who were bullied at least once a week experienced poorer health, more frequently contemplated suicide, and suffered from depression, social dysfunction, anxiety, and insomnia. Sociologist Robert Crosnoe in his book â€Å"Fitting In, Standing Out† provides new and disturbing evidence that socially marginalized youth, including victims of bullying, are less likely to go to college, which can have major implications for their adult lives. He found that feelings of not fitting in led to increased depression, marijuana use and truancy over time, which were associated with lower academic progress by the end of high school. That, in turn, lowered students’ odds of going to college. In an effort to address the widespread social ill that stems from of bullying behavior, many schools have established anti-bullying groups comprised of students and teachers. Courses are taught by administrators, community groups, and nonprofit organizations to raise awareness of the problem. Since suicide and criminal convictions are very real considerations, it is important to make the issue less of a hidden shame and more of an open discussion in classrooms everywhere.

MBA career

It is always a major life decision to choose to return to college and obtain a graduate degree. Throughout my career I have been setting goals for myself that I could accomplish with the skills and organizational abilities that I already possessed, always looking for the next step in a successful career, but at this point in my life it has become apparent that I cannot accomplish the goals that I have set for myself without first returning to college and obtaining a Masters of Business Administration, and of all of the colleges that I have researched Rice University has the one program that best fits my needs and my goals is the MBA program in Accounting and Entrepreneurship. An MBA would help me develop the skills necessary to succeed in starting and managing my own business, and eventually expanding my business internationally, and the MBA program at Rice University would help me add to the repertoire of skills that I have developed through my current work experience and allow me to grow into the leader and manager that can accomplish great things in the world of business. When I began my career in my current position as Operating Manager at Marble Slab Creamery in Houston, Texas I became instantly aware of the potential for growth that existed within the company as a franchise. In fact, Marble Slab Creamery encourages entrepreneurs who want to think outside the box, who wish to become business owners and managers, and who have a vision for the expansion of the franchise. This vision can only be accomplished with the proper leadership qualities, accountancy training, and business management skills that I can gain through an MBA program, and the MBA program at your university fits the needs that I have for having a successful career as a franchise owner and investor. My goal after obtaining my graduate degree from Rice University is to join the franchise of Marble Slab Creamery and open my own business within the United States as a way of jumping into the role of business owner and manager. Following that, my ultimate goal is to bring Marble Slab Creamery international, opening stores in my native China. There is a great deal of economic growth happening in China, and especially within cities there is a great market for expanding American businesses, like restaurants and stores, and millions of potential customers who are seeing economic growth not only in their country and communities, but within their own households. My understanding of both Chinese and American culture will become an asset because it will help me successfully develop a business plan and follow my goals for long-term overseas investments. Marble Slab Creamery has the potential to become a successful and popular store in China, and it is my hope that after developing the skills, abilities, and leadership growth that I can gain from the MBA program at your university I can move forward in my career and bring Marble Slab Creamery global. By doing so, I hope to be able to gain more financial support from the successful expansion of Marble Slab Creamery to invest in other, bigger business projects, both here and in China. My life and work experiences have allowed me to develop into a strong business and operating manager. My ambition, drive, work-ethic and ability to think outside the box are all assets that are important in accomplishing a great deal in business, both in the United States and internationally. By obtaining a graduate degree from your institution I will be able to build upon the foundation of my own abilities to become a successful business manager, investor, and owner. My strengths will also contribute to the strong environment present at Rice University, and I believe my experience will bring a great contribution to the academic environment and to my fellow students in the MBA program. Articulate Thought Essay

â€Å"Articulate speech marks [people] out as [individuals] and in some settings, this can be rather dangerous because people are often suspicious and frightened of articulateness. † (Humanities). Articulateness describes a person’s ability to express an idea coherently. A well articulated idea, concept or opinion, does not use proof based on a fallacy to back up its view. When people speak or write articulately, they are able to convey a message to others in a way that cannot be distorted. It can even be said, â€Å"[a]rticulateness builds the human community. † (Humanities) Without the ability to understand each other there would be no way for a society to function. Each person would not be able to communicate a message from his or her thoughts to another person, thus any sort of teamwork would be impossible. It is the understanding of others’ ideas told to a person in a way more specific than basic gestures or grunts that allows humans to be more successful in groups than any animal. Properly expressed thoughts are the best way to communicate in any form of society, because failing to articulate properly often leads to misinterpretation. A lack of articulation, and thus a lack of complete understanding, leads to people being misinformed. Sometimes people in power use the ability to misinform others to their advantage. By deliberately explaining campaigns vaguely so that the general public does not fully understand, people in power, or people who wish to be in power, can skew facts in their favour. â€Å"We are taught to read and write so that we can obey the traffic signs and to cipher so that we can make out our income tax† (Humanities), but people are deliberately expected to maintain only a level of intelligence sufficient to allow them to participate in society at a minimal level. People are kept in a docile state so that they will not question generally accepted ideas proposed by the government. People are only provided with education to a level insufficient to challenge the inarticulate ideas of those considered superiors. The general public is expected to automatically respect the opinions of superiors, and the people considered more powerful in society are thus able to fool the unintelligent general public. If campaigns proposed by governments were explained articulately, the people would be able to understand the true intent and make fully informed decisions. Privileged to all of the information, the general public would be able to spot any deceptions and each campaign would be subjected to scrutiny. Inarticulateness is nearly as powerful a tool as true articulateness, in some respects. By extending the human capacity of knowledge further than allowed in fundamental schooling, it is possible to overcome the system that attempts to keep society unintelligent. People are able to absorb and think about ideas of others that they have not physically met or spoken to through reading well-written literature. The more people read and are able to understand literature, the more they will develop their own articulate ideas. â€Å"As we challenge ourselves to read more and more difficult literature, we become able to extend ourselves further† (Literature). Literature allows people to â€Å"[leap] over the boundaries that usually separate us from other selves and worlds† (Literature) and increase each person’s base of knowledge substantially. It is only with prior knowledge of a subject that humans are able to intelligently articulate their ideas. However, society is not quick to embrace the powers that articulate thought gives individuals. People do not wish to pick up books unless they are necessary for their immediate success in a submissive society. â€Å"A society like ours doesn’t have much interest in literacy† (Humanities). Governments work to keep society in a level of cautious unintelligence, and are hesitant to embrace articulate ideas because they are truly powerful things. Powerful and well articulated ideas often lead to change, and change is something most people are apprehensive of. People with individual thoughts are marked out and scorned by the masses, and in many less democratic countries than Canada radical thinkers are silenced by means of intimidation or imprisonment. â€Å"Understanding and articulateness lead to [government’s] destruction† (Humanities). The government, as we know it, the system that works in a way which is not always beneficial to the general public because society remains afraid to challenge, could not exist. A well-articulated idea that goes against the government can cause upheaval in society. If people were to act on those ideas and rebel against laws put in place by the government, any sort of order would be in a state of constant flux, moving from one extreme to another. Without radicals, there would be no forward movement in humanity. Radicals such as Aristotle, who believed that there was a proper way to think and that many of the things society automatically accepts as truths are nothing more than fallacy, were scorned during their lifetimes. Many scholars’ ideas were immediately dismissed because people were frightened of their ability to articulate ideas that were radically different from those commonly held. In society there is a nature ingrained into each person, a feeling that one singled from the group will be defenseless and vulnerable. This instinct may be a result of evolution, something that humans needed in order to survive. Now it could be said the need that humans feel to conform to a group because it is presumed safer, is holding society back. Radical thinkers move humanity forward. The need for acceptance, and the desire to fit in rather than stand out in a community is something common to each person. â€Å"Young adolescents today often betray a curious sense of shame about speaking articulately† (Humanities). There is an almost paralyzing fear shared by many people, most noticeably in school children but in adults as well, of not only public speaking but also even raising their hands in a classroom setting. A child asked to give a speech to a classroom of peers about a topic, to share ideas and opinions unique to that child, will often become frightened that his or her opinions will not be shared by the rest of the class. The need for acceptance is often greater than the need to articulate and stand out. People in many cases would rather believe and agree with an idea that they have valid reason to believe to be false in order to be part of a community than voice their own opinion and be rejected. Fallacies are a barrier created by the structure of society in order to discourage articulate thought. People are often afraid of articulateness because it conveys well-formed and direct ideas, something uncommon in society. Humans are naturally afraid of something that is unfamiliar to them. An intelligent individual who thinks differently from the masses, even if his or her idea is perfectly valid and conveyed in such a way that makes their reasoning clear, are often ridiculed because society tends to accept fallacies as proof of validity. An example of a commonly believed fallacy is Circulous probando, or â€Å"thinking in circles† (Think). This term created by Aristotle, â€Å"often entails joining an intellectual herd charging round and round† (Think). The drive that humans have, the instinct to stay equal with the group both in a physical sense and an intellectual respect, leads society to want to believe in fallacies. The notion that if â€Å"everybody thinks such and such; it must be so for the simple reason that everybody thinks it is so† (Think). is safe. If everyone in the group believes a fallacy, those people are all on the same level intellectually, and there is safety in numbers. No one in the group will be singled out. The more people believe in something, be it fallacy or truth, the more likely it is that other people will believe the same simply because it is commonly accepted. This way of thinking can be detrimental to a group of people, because if the group believes in commonly held fallacies over intelligent articulate thought. â€Å"The surest way to destroy freedom is to destroy the capacity to articulate freely. † (Humanities) Without articulate freedom, human society will never progress or evolve.

Cerebrovascular disease which is the second leading cause of mortality in U K killed 21,966 men and 35,902 women in 2005. Lung cancer was the third leading cause of death in U K which caused 7.15 % death rate in males and 4.65 in women in 2005 (Hawe, 2008) According to the Health Survey of England (2009) childhood and adult obesity have increased drastically over the past 30 years. In England, about 31.4% of boys and 28.2% of the girls are either overweight or obese in 2009. The well-established Avon Longitudinal Study of Parents and Children (ALSPAC)  conducted a study on the effects of childhood obesity on proven card iovascular risk factors. The study showed that, in most cases childhood obesity is tracked into adulthood and onward; therefore, risk factors would already be present in youth will continue and finally increase risks for both cardiovascular events and diabetes in adulthood. (Logue and  Sattar, 2011) Figures from the report Statistics on Smoking: England 2010 showed that in 2009, smoking contributed to over 81,400 deaths per year in UK. The latest guidelines from the British Hypertension Society emphasize the importance of changing lifestyle choices in order to reduce the occurrence of serious cardio vascular events.( NHS, 2009) This paper emphasises the need of further action in childhood obesity control both at a population level by changing eating and exercise behaviours and at an individual level by reducing weight in a safe, successful way and thereby; reducing the risk of developing diabetes and cardio vascular diseases in adulthood. It also describes the campaigns and progra mmes arranged by public health institutions and other institutions for providing awareness about the hazards of tobacco, alcohol etc and also the necessity to follow a healthy diet from childhood in order to avoid the high risk of some diseases. Role of Public Health Services in Promoting Healthcare from early adolescents The National Health Service (NHS) Stop Smoking Services provides support to help people quit smoking. This includes intensive support through group therapy or one-to-one support provided by trained personnel, such as specialist smoking cessation advisors and trained nurses and pharmacists. During the period April 2008 to March 2009, 337,054 people successfully quit smoking with NHS Stop Smoking Services. The statistics proved that the success rate of quitting smoking increased with age, from 39% for those below 18, to 53% of those above 60. About 37% of those below 18 were failed in their quit attempt. (NHS, 2009) The Government is concerned about the increased rat e of obesity in U K. In 2007, the Government-commissioned Foresight report forecasted that 60% of men, 50% of women and 25% of children would be obese by 2050, if no action was taken. By considering the impact of obesity on people’s health, increasing the risk of type 2 diabetes, some cancers, and heart and liver disease, it has become a priority for the government to take action to reduce obesity. The government works in partnership with local government, charities and business institutions with the aim to reduce obesity by providing clear, consistent messages to people on why they should change their lifestyle, how to do so, and come up with strategies and approaches make this easier.

The Parable of the Old Man and the Young Essay The Parable of the Old Man and the Young is a short poem written by Wilfred Owen in 1920, As the title mentions, the poem is a parable. It is generally accepted that the old man, Abram, represents the European nations or more probably their governments, the first view of the poem is that it is heavily based on the story Abram (Genesis 22:1-18), where Abram is told to sacrifice his son. In the story, as he was about to sacrifice his son as an offering to God, an angel comes down and tells him to stop and to sacrifice a lamb instead. He does as hes told and makes a covenant with God saying that Abram will be the Father of a new nation. But the twist in this poem is that when Abram is told by the angel to stop, he doesnt and kills his son. But the old man would not so, but slew his son,/And half the seed of Europe, one by one. The author also manages to include metaphors and symbolisms referring to a war. Then Abram bound the youth with belts and straps, /and builded parapets and trenches there. This quote is clearly depicting an image of Isaac going unwillingly to war with the parapets and trenches. When lo! an angel called him out of heaven,/ Saying, Lay not thy hand upon the lad,/ Neither do anything to him. Behold,/ A ram, caught in a thicket by its horns;/ Offer the Ram of Pride instead of him. The quote symbolizes that all that all Abram has to do is give up his pride and not send his son Isaac to the gruesome war. But the old man would not so, but slew his son,/ And half the seed of Europe, one by one. I believe that Abram represents the government of Europe, drafting the people (Isaac) to go to their doom in war. Along with the rest of the population of Europe to die at war, heartlessly and without any regret all the government had to do was give up their pride. Probably Europe lost the war. The last two lines are the only ones that rhyme, and the image they paint is chilling: an old man methodically killing the seed of Europe. It is mainly the power of this image, set out in the poem and culminating in the last two lines, that makes it haunting. Recruiting Recruiting is a poem written by E. A. Mackintosh, who served in World War 1 until 1917 were he was killed at the Somme. Mackintosh’s poem is very bitter, heavily sarcastic and he aims to send a message to the people back in England who pressure young men to go to war. The first word in the poem is â€Å"Lads† suggests youth and innocence, which contrasts how Mackintosh sees the people who set up the campaign as the â€Å"fat civilians† which shows emphasises of how these people could not fight the war themselves. The second stanza the poet supports how the â€Å"fat civilians† could not fight by quoting them saying â€Å"Could go and fight the Hun† Knowing they will never be in danger of doing anything of the sort as they â€Å"thank God they are over fourty one† The poet also attacks the shallow girls who are often seen as the reasons why men went off to die, to please them. The girls are said to have feathers because they would give them to men who hadn’t joined up as a sign of cowardice. The songs are â€Å"vulgar songs† meaning they have little real emotion, they are shallow and crude. After the third stanza Mackintosh speaks of what the recruiting posters should say if they are honest: â€Å"the real picture of â€Å"shivering in the morning dew† and killing people â€Å"like yourselves. † Which is a frequent theme that the Mackintosh wants the reader to know that the German soldiers were ordinary men just like them. Mackibtosh also attacks the journalists as he belives that they like the war because the casualties give them something to talk about, this is shown in the line â€Å"Help o keep them nicee and safe† which is really bitter aimed at those who would send young men to die to protect their own comfort but who would do nothing about it themselves. The last line â€Å"Lad’s you’re wanted – out you go. † Ends with a dismissive phrase after the dash to show how eagerly the civilians wanted the soldiers to go.

Reasons of observations: The reason why observations are important is because it helps children know how they are improving on their development. In a observation the child and the key worker gets to know each other, they get to talk and the key worker gets a chance to play along with children and help children to socialise. Methods of observation: The main observation nurseries use is writing down and taking photographs. This helps nursery know more about the child. How to carry out observations: You must sit and watch children play If children do not know how to play you show them and give them something to play with. You then talk to children as they get to know you and get used to you You seat their and spot the child’s weakness and try to put it correct You then begin to write down what the child is doing such as analyse as they get talking and get to know you. You must understand how they are improving with a key worker observing children. When a key worker writes down on a post it note, they must write everything a child is doing with the puzzle. Such as in the baby room a child might be observed on their crawling or walking. They must tell their parents as they are babies to keep them up to date and help them know their child is in good hands. The reason for parental permission is if a stranger was to walk in and take a photograph of a child, the stranger can do anything with the child’s photograph. It is important a key worker or a member of staff CRB checked is always there to keep an eye out for children. a child who has been observed in writing, someone might have left this observation at the reception desk for someone to easily pick up this can be a document to unwanted visitors to read. This can cause the nursery big problems and lead to the nursery a penalty of closing. Identify the process for carrying out a risk assessment within the nursery environment and the steps to be taken for those items requiring attention: In a nursery a key worker has been asked to look for all hazards’s and assess what can happen: You must identify all hazards such as: Computer wire left lying and not plugged, children can trip over, and these can be protected by ensuring the plug is plugged to the socket and that worker’s check up on this. Children’s cups and plates unwashed, children become unclean, to keep protected it is up to key workers to ensure these are always washed. Chairs left in the middle of play area where children play and walk, children can fall; to keep all protected children must be shown how to seat on a chair and push the chairs under the table. Children swinging on their chair, children can fall backwards – children should be told not to swing on the chair. Toys left where children run around, children can trip over – toys must be cleared and put in the correct place. Children pushing each other, we ensure children talk to children not to push each other and report this then discuss why this happened in a meeting and find ways on how to protect children. Children playing with broken toys – it is important worker’s check all toys before children come in the morning and that this is reported and discussed at the meeting and find out why this happen so it can be reported to parents. Sharp adult scissors left for children on cutting table – this should also be put away, and reported to discuss during the meeting times in the mornings. Knives left on playing tables when should be in safe hands of an adult while cutting fruit for children during snack times- it is important to report this and be honest even thou you picked it up. Children not washing hands after toilet times- this is very important because children have to keep clean, this must be report and ensure a key worker is informed to help children wash their hands. Children running around, children can trip over and hurt themselves it is important children keep calm and walk. Children’s drawing all over the floor, staff member not seeing this and children may be walking on this and running, children’s work half ripped apart and therefore nurseries have to do double work, this must be reported and discussed. To many workers and less children, it is important this is discussed to have less worker during certain days. As a nursery we must pay attention to the risk and watch all children around us Process Administrator of the nursery creates a table of all the hazards in the nursery. The administrator then gives this to the assessment team to carry out The assessment team then rates these hazards to see if it is minor or extreme for children to be in. Reference 3 After completing the assessment this must be discussed at the meeting and then a staff meeting must be organised to inform the staff which has to check up on these risk’s at all times. We must find ways on how to stop these risks from happening; we must carry out this risk assessment once every month for regular checks. We must also write a report on how this can be protected. It is important to reach children to their chosen goal of communication, we must allow children to talk up to the level they must talk at. As children talk key worker must give contact that you are there and listening to them, children can talk about anything they like this will give children more encouragement. In a nursery setting I found that 3 years age children begin to talk full sentences. Key workers encourage children to read books, gives them talking times during circle times. Pre-schoolers like to talk more about their past life what they did. They enjoying talking rather than playing as they like to be more like adults and learn more about how adults are. To encourage pre-school children key workers ask children question as many as they can in a day to keep them confident and talking and active at all times. As key workers we encourage children to talk about the world, whatever they can think of something good. We encourage our workers to tell children to talk to each other while they play, we ask children what they are playing with as these type of question’s are common to ask. Communication can also be encouraged by giving child the time to reply back, we give children rewards on when they communicate well, we ensure all members of staff listen to children when they talk, we repeat if children do not understand the question when it is there time to talk, we show children how to answer to questions, we build children’s talking up to the highest level they can talk. In a nursery, key workers put a group of children with a similar interest in a communication activity. Key workers support children by carrying out role play. This can be a communication role play on London zoo. They can talk about animals and have an acting show to perform in front of the group. To support children we encourage children to talk, we provide as many activities we can. When key workers play with a group of children they talk more to children and ask as many questions they can. Outsourcing simply means a company based in one nation will hire from other nations in order to more efficient accomplish its goals. It makes sense on the part of the corporation, why pay a programmer in the US $80,000 a year when they can pay a programmer in India less than 1/10th of that salary, and make him a very happy man. This because even when he is earning 1/10th of the US salary, he is still earning more money than he ever hoped to get in that industry in India. It seems like a win-win situation1, but there is still a loser: The growing unemployed population of the US. As more jobs go overseas, more US citizens are finding themselves becoming obsolete. Recent History of IT in the US Between 1987 and 1997 imports used in US manufacturing rose from 10.5% to 16.2%2 and in High Technology rose from 26% to 38%. The US has a long history of outsourcing blue-collar jobs, including those that are intermediate steps within business processes in many industrial sectors. Manufacturing’s outsourcing success can be attributed to the lower cost structures found in many East Asian countries such as China, Taiwan, South Korea, and Malaysia and others2. These countries not only provide a lower cost structure, but also have a highly educated work force and business friendly environment. Outsourcing of blue-collar jobs has increased the demand of white-collar jobs in the US. The focus on white-collar jobs by US firms has pushed US profitability upwards. The outsourcing trend continues to eat up the value chain from blue-collar jobs to white collar jobs3. The software industry is experiencing an outsourcing trend to countries such as China and most significantly to India. The proliferation of the Internet has opened easier access to information and collaborative environments. Previously communication costs and access to mind power was limited. The Internet made communication costs virtually free and collaboration with groups around the makes software engineering and collaboration tasks easier. In additional, liberalization of free markets across international lines has made it easier for companies to set up and outsource engineering tasks throughout the world. Business-process and software outsourcing rely on cheaper cost structure as found in East Asia with manufacturing4.

Government Welfare

Obviously not, Welfare, at the government level, is mainly monies given to promote the basic physical and material well-being of people in need. This would include survivor benefits given to the widow/widowers of service-members. I don’t feel all areas of welfare should be abolished for instance the WIC program which provides vouchers to low income mothers to assist in buying formula and healthy foods in which would not be possible without the program.The price of baby formula can be very expensive in which millions of children would suffer from hunger, unhealthy diets and other health problems in regards to nutritional factors. Sometimes, it's just a matter of helping someone who's down on their luck for a short time, and then there are cases where you've got an elderly person who is all alone and needs some assistance. However, corporate welfare should be abolished, and regular welfare should be better managed. Anyone who is on welfare should be required to work or go to sch ool 40 hours a week to get their check; welfare should be a hand up, not a hand out.I think some people definitely need help. Sometimes, it's just a matter of helping someone who's down on their luck for a short time, and then there's cases where you've got an elderly person who is all alone and needs some assistance. That’s one-tenth of the Democratic caucus joining with the Republicans to say our people need welfare in its current state during these hard economic times. The Reform Act was started during the Clinton Administration in August of 1996. However, welfare has been a controversial issue since the 1960’s.It was not until the late 1980’s, when the citizens were concerned and asking for some kind of reform to the welfare system. I do think that over the years there have been many changes to welfare programs. Many of these changes have been good, although some have been bad. The current welfare program will not see any beneficial changes until someone offers a more beneficial way of doing things. Unfortunately there have been very few ideas to change the welfare system. Hopefully in the future this changes.

Plain View/Open Fields Case Study Essay

In the case of the purse which was dropped by a suspect who had been running from the police officers, the plain view and the open field doctrines were both applicable. According to the law, the Plain View Doctrine is applied when a police officer comes upon a contraband which is in â€Å"plain view† in any area where the presence of said police officer is legal. In such a situation, the officer could legally seize the contraband on the spot without the need of a warrant and arrest its owner for illegally possessing the substance. Only one condition should be established: that before seizing the object, said police officer should establish â€Å"probable cause† that the object is unquestionably contraband. Under such circumstances, the owner of the object in question is not protected by the Fourth Amendment (FindLaw, n.d.).   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   On the other hand, according to the Open Fields Doctrine, the owner of an object located out of doors where it could be plainly seen or accessible to anybody who is on foot, from inside any motor vehicle, or a low-flying aircraft, could not seek the privacy protection under the Fourth Amendment. This means that even if a dwelling unit is protected by a fence, the fenced-in ground is still considered an â€Å"open field† if people can easily peep through cracks in the fence, or if the fence is low enough for people to have a clear view of the ground inside without standing on their toes or on top of any object in order to have a clear line of sight. The protection against intrusion exercised by the owner such as a locked gate is also taken into consideration. Open fields include streets, sidewalks, bodies of water, outdoor fields, or even the â€Å"cartilage† of a fenced-in residential building if it is in plain view of people standing outside the fence (FindLaw, n.d.). The purse was dropped in a place which was accessible to anybody at all times of the day, being a back alley where residents deposit their trash for the garbage collectors to pick up. In other words, the presence of any person in that area, including police officers, could not be considered unlawful. These circumstances made that particular alley an open field. The doctrine on open fields is therefore applicable. In addition, when the purse was dropped, it sprung open and spilled most of its contents on the ground, including the marijuana sticks. In other words, the police officer immediately saw the marijuana sticks when he came back for the purse after failing to catch up with the escaping man because they were in â€Å"plain view.† Given that the place where the purse was dropped could be considered an open field and that the marijuana sticks were in plain view of the officer in a place where the presence of said officer is not unlawful, the open field doctrine as well as the doctrine of plain view could both be applied to the case of the dropped purse. This being the case, the marijuana sticks could therefore be legally seized and used as evidence to justify the arrest of the owner of the purse. Had the purse stayed tightly closed when it was dropped and the marijuana sticks remained hidden from plain view, it could not have been the subject of a legal seizure proceeding. In the case of the two boys who were fighting inside a fenced-in residence, the two doctrines were again applicable. When the officers who failed to catch up with the suspect went back for the purse which was dropped on the alley, it was then that Officer Nelson heard the commotion inside a fenced-in yard. When he went near the fence of the nearest residence, he found that he could easily see into the fenced-in ground of the house without having to stand on his toes or on top of any object. The fenced-in ground, therefore, fell under the open field doctrine because what was happening inside could easily be observed by anybody passing by the fence. Then, since Officer Nelson saw the violent incident involving two teenage boys, it became his duty, being a peace officer, to break up the fight and prevent further physical damage to the boys involved. He therefore felt duty-bound to enter the premises. The fact that the gate to the backyard was not locked proved that his entry was not forced therefore he did not violate the Fourth Amendment. This is because an unlocked gate is an indication that the owner of the premises did not expect too much privacy by not restricting entry into an â€Å"open field.† In addition, â€Å"no entry† signs were not posted either on the fence or on the gate. In U.S. v. Thomas, supra, the court ruled that police officers who entered an apartment through an open gate were not violating the rights of the owners under the Fourth Amendment, noting that the open gate indicated that entering did not require permission from the owner or occupant of the apartment. It also pointed out that there was no other indication or warning that unauthorized entry was not allowed. All things considered, the court ruled that the gate only served as the entrance to the apartment and not as a means of preventing people from entering simply because it was open (as cited in State vs. Ramaekers, 1999). The circumstances which attended U.S. v. Thomas were identical to the circumstances present in the case study: There was a fence, and a gate, but the latter was not locked, and no â€Å"do not enter† signs were posted. The ruling in U.S. v. Thomas is therefore applicable to the case study when the police officers entered the fenced-in ground. The Open Field Doctrine, however, was applicable only as far as the breakup of the fight between the two boys was concerned. Since Officer Nelson did not yet see the baggies when he was outside the fence, it could not be applied to the baggies which contained the contraband. However, when he approached the door to the patio to call the guardians of the boys, he saw the baggies in â€Å"plain view† on top of the table near the door. At that point, the discovery of the white substance fell under the doctrine of plain view. It was discovered by Officer Nelson â€Å"inadvertently† in a place where his presence was legitimate. It should be emphasized that Officer Nelson’s presence in the area was to break up a fight which he had observed from the alley outside the fence of that residence. In addition, it was not necessary for the officer to establish probable cause that the white substance was contraband because the woman who came out of the house in response to his call immediately confirmed that the substance was indeed contraband. The seizure was therefore lawful under the Plain View Doctrine and the contraband should be admissible as evidence in court (Findlaw, n.d.).

Quality data and reporting : Quality information has to be readily available and the information should be part of the visible management system. Records about quality indicators have to be kept, including scrap, rework, and cost of quality. TQM and Change Management Initiative for IT Performance : A business firm achieves world-class status when it has successfully developed operational capabilities through TQM to support the entire company in gaining a sustained overall performance over its competitors. Although there is insufficient statistical evidence to conclude significant simple relationships between TQM and IT services quality performance, many studies investigated the notion that TQM practices provide approaches to improve the economic position in the service sectors in general.
